Messages: SMS, Dialer & Home

These Terms of Use (“Terms”) govern your use of the mobile application Messages: SMS, Dialer & Home (“App”, “we”, “us”, or “our”).


By downloading, installing, accessing, or using the App, you agree to these Terms.


If you do not agree with these Terms, please do not use the App.



1. OUR SERVICES


Messages: SMS, Dialer & Home is an Android communication application that may provide features including:


• SMS and MMS messaging

• Default SMS functionality

• Phone dialer

• Making and receiving phone calls

• Default Phone/Dialer functionality

• Contacts

• Recent calls and call history

• Missed, incoming, and outgoing calls

• After Call Screen

• Spam call and message blocking

• Scheduled messages

• SMS organization

• Backup and restore

• Custom notifications

• Home/launcher functionality

• Free ad-supported features

• Premium or Pro subscription features


Features may vary depending on your device, Android version, country, App version, permissions, and default-app settings.



2. DEFAULT SMS AND PHONE/DIALER FUNCTIONALITY


Certain App features require you to select Messages: SMS, Dialer & Home as your Default SMS application and/or Default Phone/Dialer application.


If you do not select the App as the required default handler, some SMS, calling, call-history, or related features may not function.


You may change your default SMS or Phone application at any time through Android Settings.



3. PERMISSIONS


The App requires certain device permissions to provide functionality requested by you.


These permissions may include access to:


• SMS and MMS

• Call Logs

• Phone status

• Phone calling

• Contacts

• Notifications

• Photos, videos, or files

• Foreground services

• Overlay functionality

• Other device features required for supported functionality


Permissions are used as described in our Privacy Policy.


You may revoke permissions through your device settings, although doing so may prevent certain App features from functioning correctly.



4. USER RESPONSIBILITIES


You agree to use the App only for lawful purposes.


You must not use the App to:


• Harass, threaten, abuse, or impersonate another person

• Send unlawful or prohibited messages

• Make unlawful or abusive phone calls

• Send spam or unsolicited communications in violation of applicable law

• Attempt to interfere with or damage the App

• Circumvent security mechanisms

• Reverse engineer or misuse the App except where permitted by applicable law

• Use the App in any manner that violates applicable laws or third-party rights


You are responsible for messages and calls initiated through your device and for any applicable carrier charges.



5. TELECOMMUNICATION AND CARRIER CHARGES


SMS, MMS, phone calls, mobile data, roaming, and other telecommunications functionality may be provided by your mobile carrier.


Your carrier may charge fees for:


• SMS messages

• MMS messages

• Phone calls

• Mobile data

• International calls

• Roaming


We do not control carrier charges.


You are responsible for all fees charged by your telecommunications provider.



6. CONTACTS, MESSAGES AND CALL INFORMATION


You are responsible for ensuring that your use of contact information, messages, calls, and other communications complies with applicable laws.


The App processes information necessary to provide messaging and calling functionality as explained in our Privacy Policy.



7. SPAM BLOCKING


The App may provide tools that allow you to block selected calls, phone numbers, contacts, or messages.


Spam detection or blocking functionality may not identify or block every unwanted communication.


Legitimate calls or messages may occasionally be classified incorrectly.


You remain responsible for reviewing your call and message activity.



8. FREE VERSION AND ADVERTISING


The App may provide a free version supported by advertising.


Advertisements may be provided by third-party advertising services.


We do not control all advertisements displayed by third-party advertising providers.


Your interaction with an advertisement or third-party service is governed by that provider’s applicable terms and privacy policy.



9. PREMIUM / PRO SUBSCRIPTION


The App may offer an optional Premium or Pro subscription.


Premium benefits may include, depending on the plan offered:


• Removal of advertisements

• Unlocking paid functionality

• Access to premium features

• Other benefits displayed on the subscription screen


The exact subscription price, billing period, benefits, and applicable introductory offers will be shown before you complete the purchase.



10. SUBSCRIPTION BILLING AND AUTOMATIC RENEWAL


Subscriptions are processed through Google Play.


Unless otherwise stated at the time of purchase, subscriptions automatically renew at the end of each billing period until cancelled.


Your Google Play account will be charged according to the price and billing frequency displayed during purchase.


Subscription prices may differ depending on your country, currency, taxes, or Google Play pricing.



11. CANCELLING A SUBSCRIPTION


You may manage or cancel your subscription through your Google Play account.


Deleting or uninstalling the App does not automatically cancel an active subscription.


To prevent the next renewal charge, cancel according to the cancellation requirements shown by Google Play before the applicable renewal date.


After cancellation, Premium access may remain available until the end of the already-paid subscription period.



12. FREE TRIALS AND PROMOTIONAL OFFERS


We may occasionally offer free trials, introductory pricing, or promotional subscription offers.


The eligibility, duration, price, and renewal conditions of any offer will be disclosed before purchase.


Unless cancelled before the end of an applicable trial or promotional period, the subscription may automatically convert to a paid subscription at the price shown during signup.



13. PAYMENTS AND REFUNDS


Purchases and subscription payments are processed by Google Play.


Refund requests are subject to Google Play policies, applicable consumer law, and any other rights that may apply in your jurisdiction.


We do not directly process or store your complete payment-card information.



14. INTELLECTUAL PROPERTY


The App, including its:


• Software

• Source code

• Design

• User interface

• Graphics

• Logos

• Branding

• Original content


is owned by us or our licensors and is protected by applicable intellectual-property laws.


These Terms grant you a limited, personal, non-exclusive, non-transferable, and revocable right to use the App for its intended purpose.


You may not copy, modify, distribute, sell, sublicense, or commercially exploit the App except where expressly permitted by us or applicable law.



15. THIRD-PARTY SERVICES


The App may interact with third-party services including:


• Google Play

• Advertising providers

• Analytics services

• Device or telecommunications services

• External websites


Those services may be governed by separate terms and privacy policies.


We are not responsible for services operated independently by third parties.



16. AVAILABILITY AND CHANGES


We may:


• Add new features

• Modify existing features

• Remove features

• Update the interface

• Fix bugs

• Change technical requirements

• Discontinue portions of the App


We do not guarantee that every feature will remain available indefinitely.



17. TERMINATION


You may stop using the App at any time by uninstalling it.


We may restrict or discontinue access to the App where reasonably necessary, including where:


• These Terms have been violated

• The App is being misused

• Continued operation creates legal or security risks

• We discontinue the service


Provisions that by their nature should survive termination will remain effective.



18. DISCLAIMER


The App is provided on an “AS IS” and “AS AVAILABLE” basis to the extent permitted by law.


We do not guarantee that:


• The App will always operate without interruption

• Every call will successfully connect

• Every SMS or MMS will be successfully delivered

• Spam blocking will identify every unwanted communication

• Backup functionality will prevent every possible loss of information

• The App will be completely free of errors


Network availability, mobile carrier services, device settings, Android services, and third-party systems may affect App functionality.



19. LIMITATION OF LIABILITY


To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, or punitive damages resulting from use of or inability to use the App.


This may include losses resulting from:


• Failed or delayed communications

• Loss of messages or data

• Telecommunications interruptions

• Device or network problems

• Third-party services

• Incorrect spam classification


Nothing in these Terms excludes rights or liabilities that cannot legally be excluded under applicable law.



20. PRIVACY


Your use of the App is also governed by our Privacy Policy.


The Privacy Policy explains how information is accessed, processed, used, and protected when you use messaging, calling, contact, advertising, subscription, and other App features.



21. CHANGES TO THESE TERMS


We may update these Terms from time to time.


The updated Terms and effective date will be posted on this page.


Your continued use of the App after updated Terms become effective constitutes acceptance of the revised Terms, where permitted by applicable law.



22. GOVERNING LAW AND DISPUTES


These Terms are governed by applicable laws.


If you have a concern or dispute regarding the App, please contact us first so that we can attempt to resolve the issue informally.


Nothing in these Terms limits mandatory consumer rights available under applicable law.
